Tom Sandoval responded to the complaint she filed on the partition so she can force the sale of the property.

He’s against a partition and he admits he has a lien on the property.

And if the court orders partition anyways he wants compensatory damages paid what for who knows and taxes and other improvements split.

So he doesn’t want to force sale. Likely he wants to buy her out plus he’ll factor in lien bc legally it’s both of their lien.

And she wants partition and then basically his share pays off his lien.

That lien is a problem for him. So she and him could have had a contract that said you can take a lien on the house for your bar but you have to pay it back… she hasn’t said they have a contract But she may be saving that if the case goes forward to support the partition and then his portion paying the lein. She may be screwed if she doesn’t and it’s her debt too.

so bottom line

To buy her out the court sets the fair market value and then less the lien which she will say isn’t mine and to settle they will offer fair market value based on threee appraisals and try to figure out her part less the lein or a portion of it.

If he can’t pay that the house gets sold.

And final note on this.. he can’t sell the house with out a lien release it has to be paid. He wants to keep the house so he doesn’t have to pay the lien that’s what this is about
