“Real Housewives of Potomac” star Wendy Osefo and her husband, Eddie Osefo, are standing united publicly — but not in the courtroom. The Bravo couple, both 41, recently requested separate trials following their arrests earlier this month on charges of insurance fraud, conspiracy, and making a false statement to a police officer.

The Osefos, accused of staging a home robbery in April 2024, filed individual motions in October to be tried separately. While some fans see this as a red flag, legal experts say it’s actually a smart strategy.

Some reasons the two may want to be tried separately include different defense strategies related to one defendant-spouse not wanting to be prejudiced by evidence against the other spouse,” criminal defense attorney John W. Day told Us Weekly. “And there may be evidence against one spouse that’s not strong against the other. This is a smart move by the defense lawyers. It’s not unusual at all for spouses to want their cases severed from each other.”

Attorney Lauren Johnson-Norris agreed, telling US Weekly that the decision is “quite common” for couples indicted together. “Separately trying spouses may give each individual a better chance to control their own defense, avoid the risks of ‘guilt by association,’ and pursue negotiated outcomes tailored to their circumstances,” she explained.

Eddie and Wendy Osefo’s Legal Motions Explained

Wendy filed her court documents on October 17, asking for the charges to be dismissed and her arrest declared illegal. She also requested her own trial, separate from Eddie’s. “The motions that were filed by our legal team are standard motions that are filed in every criminal case in Maryland,” Wendy’s attorney told the outlet. “These motions are intended to prompt prosecutors to produce evidence pursuant to the Maryland Rules. It is routine to file these motions at the outset of every case to preserve evidence and assert our clients’ rights.”

A week later, on October 24, Eddie filed similar paperwork, asking for his charges to be dropped and for a separate trial as well.

The couple has continued to present a united front on social media, posting family photos and upbeat captions while staying quiet on the legal front. But behind the scenes, their separate legal paths suggest a more complex reality — one that could play out dramatically during “The Real Housewives of Potomac” season 10.

“The Real Housewives of Potomac” season 10 airs Sundays at 8/7c on Bravo.
