Netflix had been sent a cease and desist from her soon to be ex’s attorneys during filming but it did not matter because they had all the proper location agreements in place before shooting started (which would have included hisblessing). Permission was already granted to film in the apartment so it’s hard to rescind that after the fact. My guess is it was a scare tactic so that they don’t make him look too bad in the edit.
